These Terms & Conditions are a legal agreement between you and Jungle Bravo, operated by Babel Group Inc.

Please read these Terms carefully before using our website, purchasing our products, enrolling in a subscription, or interacting with our services.

2. Acceptance of These Terms

By accessing or using the Website, creating an account, placing an order, enrolling in a subscription, submitting information, or interacting with Jungle Bravo, you agree to be bound by these Terms and any policies incorporated by reference, including our Privacy Policy, shipping policy, return/refund policy, subscription terms, promotional terms, and any product-specific terms.

If you do not agree to these Terms, you must not use the Website, purchase products, or enroll in any subscription or recurring purchase program.

You represent that you are legally able to enter into a binding agreement. If you use the Website or purchase products on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.

3. Eligibility

You must be at least the age of majority in your province, state, territory, or country of residence to use the Website or purchase products from Jungle Bravo.

We do not guarantee that any product, offer, subscription, feature, promotion, or content will remain available at all times or in all locations.

We are not liable for any modification, suspension, discontinuation, unavailability, delay, or removal of any Website feature, product, service, subscription, or offer, except to the extent required by applicable law.

5. Account Registration and Account Security

You may be required or permitted to create an account to place orders, manage subscriptions, view order history, save preferences, or access certain Website features.

You agree to provide accurate, current, and complete account information and to promptly update your information as needed. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to notify us immediately at help@junglebravo.com if you believe your account, password, payment method, or personal information has been lost, stolen, compromised, or used without authorization.

We may suspend, restrict, or terminate your account if we believe that your information is inaccurate, incomplete, fraudulent, unauthorized, or otherwise in violation of these Terms.

6. Prohibited Uses

You agree not to use the Website, products, services, subscriptions, or communications for any unlawful, harmful, fraudulent, abusive, or unauthorized purpose.

You agree not to:

• Violate any applicable law, regulation, rule, or third-party right;
• Provide false, inaccurate, misleading, or incomplete information;
• Use another person’s account, identity, payment method, address, or personal information without authorization;
• Engage in fraud, payment abuse, chargeback abuse, refund abuse, promotion abuse, discount abuse, or subscription abuse;
• Interfere with or disrupt the Website, servers, payment systems, security systems, or business operations;
• Attempt to gain unauthorized access to any account, system, network, data, or service;
• Use bots, scrapers, crawlers, automated tools, or data extraction methods without our prior written permission;
• Copy, reproduce, resell, exploit, or commercially use the Website, products, branding, content, or services without authorization;
• Submit reviews, comments, photos, testimonials, or other content that is false, defamatory, obscene, abusive, infringing, misleading, unlawful, or otherwise inappropriate;
• Use our products in a manner inconsistent with product labels, warnings, instructions, or intended use;
• Resell or distribute Jungle Bravo products without our prior written authorization; or
• Engage in any conduct that may harm Jungle Bravo, our customers, our service providers, our payment processors, or our business operations.

We reserve the right to investigate suspected violations and take any action we consider appropriate, including refusing service, cancelling orders, terminating accounts, blocking access, reporting conduct to authorities, or pursuing legal remedies.

7. Products, Orders, Billing, and Account Information

By placing an order, you agree to provide current, complete, and accurate billing, shipping, contact, and payment information.

All orders are subject to acceptance by Jungle Bravo. We may refuse, cancel, limit, or modify any order at any time, including after an order confirmation has been sent, if we believe the order involves inaccurate information, payment issues, suspected fraud, unauthorized activity, resale activity, pricing errors, inventory issues, shipping restrictions, policy violations, or other circumstances we consider appropriate.

You authorize Jungle Bravo and our third-party payment processors to charge your selected payment method for the total amount of your order, including products, shipping, handling, taxes, duties, fees, subscription charges, and any other applicable amounts.

You represent and warrant that you are authorized to use any payment method you provide.

If your payment method is declined, expired, invalid, reversed, charged back, or otherwise not successfully processed, we may cancel your order, suspend your subscription, restrict your account, or attempt to collect amounts owed, to the fullest extent permitted by law.

8. Pricing, Product Availability, and Errors

We make reasonable efforts to display accurate product descriptions, images, ingredients, prices, promotions, availability, shipping options, and other information. However, errors may occur.

We do not guarantee that product descriptions, images, colours, packaging, ingredient lists, prices, promotions, availability, subscription terms, shipping estimates, or other Website content will always be accurate, complete, current, or error-free.

We reserve the right to correct errors, inaccuracies, or omissions at any time, including after an order has been submitted. We may cancel, refuse, modify, or limit any order affected by an error, pricing mistake, inventory issue, promotional mistake, or other inaccuracy.

Product images are for illustrative purposes only. Actual product appearance, colour, packaging, size, texture, scent, or presentation may vary.

9. Subscriptions and Recurring Billing

If you purchase a subscription, auto-renewal plan, replenishment program, or other recurring purchase option, you authorize Jungle Bravo and our payment processors to automatically charge your selected payment method at the recurring interval disclosed at the time of purchase, unless and until you cancel in accordance with the applicable cancellation instructions.

Subscription charges may include the product price, shipping, handling, taxes, and any other applicable fees. The amount charged may vary due to changes in product price, taxes, shipping costs, discounts, promotions, product selections, or subscription modifications.

You are responsible for keeping your billing, shipping, contact, and payment information accurate and up to date. If your payment method fails, we may attempt to process the payment again, contact you for updated information, suspend your subscription, cancel your subscription, or take other action permitted by law.

You may cancel your subscription by following the cancellation instructions provided through your account, subscription portal, order confirmation, or by contacting us at help@junglebravo.com. To avoid being charged for the next subscription order, you must cancel before the applicable billing or renewal date.

Changes, skips, pauses, or cancellations may not affect orders that have already been processed, billed, packed, shipped, or otherwise fulfilled.

We may modify, suspend, or cancel subscription offerings at any time, subject to applicable law. If required by law, we will provide notice of material subscription changes.

10. Shipping and Delivery

We will make reasonable efforts to process and ship orders in a timely manner. Shipping times, processing times, delivery dates, and carrier estimates are estimates only and are not guaranteed unless expressly stated otherwise.

Shipping may be handled by third-party carriers, fulfillment providers, or logistics partners. Once an order is transferred to a carrier, delivery timing and handling may be outside our control.

You are responsible for providing a complete, accurate, and deliverable shipping address. Jungle Bravo is not responsible for delays, losses, returns, failed deliveries, or additional costs caused by incorrect, incomplete, outdated, undeliverable, or restricted addresses provided by you.

Risk of loss may pass to you upon delivery to the shipping address provided, except where applicable law requires otherwise.

We are not responsible for carrier delays, customs delays, weather delays, lost or stolen packages after confirmed delivery, delivery exceptions, failed delivery attempts, package forwarding issues, or events outside our reasonable control, except to the extent required by law.

If a package is returned to us due to an incorrect address, failed delivery, refusal, non-collection, or other customer-related issue, we may, in our discretion, offer reshipment at your expense, issue a refund less applicable shipping and handling costs, or take another appropriate action.

11. Returns, Refunds, and Exchanges

You may request a return within 30 days of delivery by contacting us at help@junglebravo.com.

To be eligible for a return, the product must be unused, unopened, undamaged, and in its original packaging, unless the product is damaged, defective, incorrect, or otherwise required to be accepted by law.

To start a return, you must contact Jungle Bravo for return instructions before sending any product back. Unauthorized returns may be refused and may not be eligible for a refund.

Unless otherwise stated or required by law, sale items, clearance items, promotional items, gift cards, digital products, opened products, used products, and products not in their original condition are final sale and are not eligible for return or refund.

You are responsible for return shipping costs unless the return is due to a damaged, defective, or incorrect item. Original shipping fees are non-refundable unless otherwise required by law.

Once we receive and inspect your return, we will notify you whether your refund has been approved. Approved refunds will be issued to the original payment method. Your bank or payment provider may require additional time to process and post the refund.

We reserve the right to deny returns or refunds that do not comply with these Terms, show signs of use, damage, tampering, contamination, abuse, or are otherwise inconsistent with our policies, subject to applicable law.

12. Damaged, Defective, Incorrect, or Missing Items

Please inspect your order promptly upon delivery.

If you receive a damaged, defective, incorrect, or incomplete order, you must contact us at help@junglebravo.com within 7 days of delivery and provide your order number, a description of the issue, and any requested photos or documentation.

If we determine that your item was damaged, defective, incorrect, or missing due to an error by Jungle Bravo, the carrier, or our fulfillment provider, we may, in our discretion, offer a replacement, refund, store credit, or other appropriate remedy.

We reserve the right to deny claims that are submitted after the applicable reporting period, lack sufficient documentation, involve misuse or improper handling, or are otherwise inconsistent with our policies.

Nothing in this section limits any rights you may have under applicable consumer protection laws.

13. Product Information and No Professional Advice

All product descriptions, content, materials, articles, recommendations, statements, and other information provided on or through the Website are for general informational purposes only. They are not intended to be, and should not be relied upon as, medical, dermatological, cosmetic, nutritional, health, safety, legal, or other professional advice.

Jungle Bravo products are cosmetic and personal care products unless expressly stated otherwise. Our products are not intended to diagnose, treat, cure, or prevent any disease, medical condition, skin condition, or health condition.

Jungle Bravo does not guarantee any particular result from the use of our products. Individual results may vary depending on many factors, including skin type, hair type, body chemistry, product use, frequency of use, environment, age, lifestyle, sensitivities, allergies, and other circumstances.

You are responsible for reading all product labels, ingredient lists, warnings, directions, and instructions before use. Before using any cosmetic or personal care product, you should consider performing a patch test, especially if you have sensitive skin, known allergies, or prior reactions to cosmetic or personal care products.

If irritation, redness, discomfort, allergic reaction, sensitivity, rash, burning, swelling, or other adverse reaction occurs, you should discontinue use immediately and consult a qualified healthcare professional if needed.

If you are pregnant or nursing, taking medication, have a medical condition, skin condition, allergy, sensitivity, or concern about whether a product is appropriate for you, you should consult a qualified professional before using the product.

Unless expressly stated and legally permitted, statements made on the Website or in our marketing materials have not been evaluated by the Food and Drug Administration, Health Canada, or any other regulatory authority. Our products are not intended to diagnose, treat, cure, or prevent any disease.

14. Customer Reviews, Testimonials, and User Content

If you submit, post, upload, tag, send, or otherwise provide any reviews, testimonials, comments, photos, videos, feedback, suggestions, social media content, or other content to Jungle Bravo or about Jungle Bravo, including by tagging us or using our branded hashtags, you grant Jungle Bravo and Babel Group Inc a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to use, reproduce, display, publish, distribute, edit, adapt, modify, create derivative works from, and otherwise exploit that content in any media or format, including for advertising, marketing, promotional, product development, and commercial purposes.

You represent and warrant that you own or have all rights necessary to submit the content and grant the license above, and that your content does not violate any law, infringe any third-party rights, contain false or misleading statements, or include defamatory, obscene, abusive, harmful, or otherwise inappropriate material.

Jungle Bravo may, but is not obligated to, monitor, edit, remove, reject, or refuse to display any user content at any time and for any reason.

Submission of feedback, ideas, or suggestions does not create any obligation for Jungle Bravo to compensate you or treat such information as confidential.

You agree that testimonials, reviews, before-and-after content, or product experience statements reflect individual experiences and do not guarantee that other customers will achieve the same or similar results.

15. Intellectual Property

The Website and all content, materials, and intellectual property displayed on or made available through the Website are owned by or licensed to Jungle Bravo, Babel Group Inc, or our licensors and are protected by copyright, trademark, trade dress, and other intellectual property laws.

This includes, without limitation, the Jungle Bravo name, logos, trademarks, service marks, product names, product packaging, product images, product descriptions, text, graphics, icons, photographs, videos, designs, layouts, look and feel, website content, software, code, advertisements, marketing materials, and other brand assets.

You may not copy, reproduce, modify, adapt, translate, publish, display, distribute, transmit, sell, resell, license, create derivative works from, or otherwise exploit any part of the Website, products, content, branding, or intellectual property without our prior written permission.

Nothing in these Terms transfers any ownership rights to you. All rights not expressly granted are reserved by Jungle Bravo, Babel Group Inc, and their respective licensors.

16. Third-Party Services, Links, and Payment Processors

The Website may contain links to, integrations with, or functionality provided by third-party websites, applications, platforms, tools, payment processors, subscription management providers, shipping carriers, fulfillment providers, email and SMS providers, analytics providers, advertising partners, social media platforms, or other service providers.

These third-party services are provided for convenience or to operate our business, process payments, manage subscriptions, fulfill orders, deliver communications, improve the Website, or provide related services.

Your use of third-party services may be subject to separate terms, conditions, fees, and privacy policies imposed by those third parties.

Jungle Bravo does not control and is not responsible for any third-party websites, services, content, products, policies, practices, errors, delays, security incidents, or actions. Your interactions with third parties are solely between you and the applicable third party.

We are not liable for any loss, damage, delay, error, charge, fee, or issue arising from your use of or reliance on any third-party website, service, platform, processor, carrier, or provider, except to the extent required by applicable law.

17. Privacy and Communications

Your use of the Website and purchase of products from Jungle Bravo are also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect personal information.

By using the Website, creating an account, placing an order, enrolling in a subscription, contacting us, or otherwise providing your information, you consent to receive electronic communications from Jungle Bravo, Babel Group Inc, and our service providers.

These communications may include order confirmations, payment confirmations, shipping updates, delivery updates, account notices, subscription notices, renewal reminders, cancellation confirmations, customer service messages, policy updates, and other transactional or administrative communications.

If you opt in to receive marketing communications, you may also receive promotional emails, SMS/text messages, offers, product updates, subscription offers, abandoned cart reminders, and other marketing communications from Jungle Bravo.

You may unsubscribe from marketing emails by using the unsubscribe link in the email. You may opt out of SMS/text marketing by replying STOP or following the instructions provided in the message.

Message and data rates may apply. Message frequency may vary.

Opting out of marketing communications does not prevent us from sending transactional, account, order, subscription, legal, or service-related communications where permitted by law.

18. SMS / Text Message Terms

If you provide your mobile phone number and opt in to receive text messages from Jungle Bravo, you consent to receive recurring automated and non-automated text messages from or on behalf of Jungle Bravo, including promotional messages, product offers, abandoned cart reminders, subscription notices, order updates, customer service messages, and other communications.

Consent to receive marketing text messages is not required as a condition of purchasing any product or service from Jungle Bravo.

Message frequency may vary. Message and data rates may apply.

You may opt out of marketing text messages at any time by replying STOP to any text message you receive from us or by following the instructions provided in the message. You may receive a final confirmation message after opting out.

Mobile carriers are not liable for delayed, failed, or undelivered messages.

You represent that you are the account holder or authorized user of any mobile number you provide to Jungle Bravo. If you change or deactivate your mobile number, you agree to update your account information or notify us so we can avoid sending messages to the wrong person.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the Website, products, services, content, offers, subscriptions, and communications provided by Jungle Bravo are provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, statutory, or otherwise.

Jungle Bravo disclaims all warranties, including without limitation any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, uninterrupted operation, error-free operation, and any warranties arising from course of dealing or usage of trade.

We do not warrant that the Website will be uninterrupted, secure, timely, accurate, complete, or free from errors, viruses, or harmful components.

We do not warrant that any product description, image, ingredient list, pricing, availability, promotional offer, subscription term, or other content will always be accurate, complete, current, or error-free.

Jungle Bravo does not guarantee any specific cosmetic, personal care, skin, hair, appearance, wellness, or other result from the use of our products. Individual results may vary based on skin type, hair type, sensitivities, allergies, body chemistry, frequency of use, environment, lifestyle, and other factors.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such jurisdictions, warranties are excluded only to the maximum extent permitted by applicable law.

Nothing in these Terms excludes, restricts, or modifies any warranty, right, remedy, or protection that cannot be excluded, restricted, or modified under applicable consumer protection law.

20. Limitation of Liability

To the fullest extent permitted by law, Jungle Bravo, Babel Group Inc, and their respective owners, officers, directors, employees, contractors, agents, affiliates, service providers, licensors, suppliers, fulfillment partners, and payment processors will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including without limitation lost profits, lost revenue, lost savings, loss of data, business interruption, reputational harm, replacement costs, or loss of goodwill, arising out of or related to your access to or use of the Website, products, subscriptions, orders, communications, or these Terms, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, Jungle Bravo is not liable for damages or losses arising from product misuse, failure to follow directions or warnings, allergic reactions, sensitivities, irritation, individual skin or hair responses, failure to perform a patch test, use with other products, improper storage, third-party carrier delays, lost or stolen packages after delivery, failed payment processing, unauthorized account access caused by you, or events outside our reasonable control.

To the fullest extent permitted by law, Jungle Bravo’s total cumulative liability for any claim arising out of or related to the Website, products, orders, subscriptions, communications, or these Terms will not exceed the greater of:

• The amount you paid to Jungle Bravo for the specific product, order, or subscription charge giving rise to the claim; or
• One hundred Canadian dollars.

Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities, so some of the above limitations may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by applicable law.

Nothing in these Terms limits liability where liability cannot be limited under applicable law.

21. Indemnification

You agree to defend, indemnify, and hold harmless Jungle Bravo, Babel Group Inc, and their respective owners, officers, directors, employees, contractors, agents, affiliates, licensors, suppliers, fulfillment partners, service providers, and payment processors from and against any claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• Your access to or use of the Website;
• Your purchase, use, misuse, storage, resale, or distribution of any product;
• Your failure to follow product labels, warnings, directions, ingredient information, or instructions;
• Your allergic reaction, sensitivity, irritation, or adverse response caused by your use or misuse of products, except to the extent caused by Jungle Bravo’s gross negligence or willful misconduct;
• Your breach or alleged breach of these Terms;
• Your violation of any law, regulation, or third-party right;
• Your fraud, misrepresentation, negligence, misconduct, or unauthorized activity;
• Your user content, reviews, testimonials, photos, videos, feedback, or submissions;
• Your abuse of promotions, discounts, subscriptions, refunds, returns, chargebacks, or payment processes; or
• Your use of the Website or products in a manner not authorized by Jungle Bravo.

Jungle Bravo reserves the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

22. Force Majeure

Jungle Bravo will not be liable or responsible for any delay, failure, or inability to perform any obligation under these Terms where the delay or failure results from events beyond our reasonable control, including without limitation acts of God, natural disasters, severe weather, fire, flood, earthquakes, war, terrorism, civil unrest, labor disputes, strikes, supplier delays, manufacturing delays, ingredient or packaging shortages, fulfillment disruptions, carrier delays, customs delays, power outages, internet or telecommunications failures, cyber incidents, government actions, changes in law, public health emergencies, pandemics, epidemics, or other events beyond our reasonable control.

If such an event occurs, our obligations will be suspended or extended for the duration of the event, and we may cancel, delay, limit, or modify affected orders, subscriptions, shipments, products, or services as reasonably necessary.

23. Governing Law and Dispute Resolution

These Terms, and any dispute, claim, or controversy arising out of or relating to these Terms, the Website, products, orders, subscriptions, communications, or your relationship with Jungle Bravo, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Before starting any formal legal proceeding, you agree to first contact us at help@junglebravo.com and attempt to resolve the dispute informally. You must provide your name, order number if applicable, contact information, a description of the dispute, and the relief you are seeking. We will attempt to resolve the dispute in good faith.

Subject to applicable consumer protection laws and any rights you may have under the laws of your place of residence, you agree that any dispute, claim, or proceeding arising out of or relating to these Terms, the Website, products, orders, subscriptions, communications, or your relationship with Jungle Bravo shall be brought in the courts located in Ontario, Canada, and you consent to the personal jurisdiction of those courts.

Class Action Waiver

To the fullest extent permitted by applicable law, you and Jungle Bravo agree that any dispute, claim, or proceeding must be brought only on an individual basis and not as a plaintiff, class member, or representative in any class action, collective action, representative action, private attorney general action, or similar proceeding.

No court or other decision-maker may consolidate claims or preside over any form of class, collective, or representative proceeding unless required by applicable law.

Nothing in this class action waiver limits any non-waivable rights you may have under applicable consumer protection laws.

Injunctive Relief

Nothing in this section prevents Jungle Bravo from seeking temporary, preliminary, or permanent injunctive relief in any court of competent jurisdiction to protect its intellectual property, confidential information, payment systems, account security, business operations, or the Website from unauthorized use, infringement, misuse, or abuse.

If any part of this dispute resolution section is found unenforceable, the unenforceable portion shall be severed, and the remaining provisions shall remain in effect to the fullest extent permitted by law.

24. Termination and Suspension

Jungle Bravo reserves the right, in its sole discretion and to the fullest extent permitted by law, to suspend, restrict, disable, or terminate your access to the Website, account, subscriptions, promotions, offers, or services at any time, with or without notice, if we believe that you have violated these Terms, engaged in fraud or unauthorized activity, abused promotions or discounts, misused the Website, submitted false or misleading information, initiated abusive chargebacks, violated applicable law, infringed third-party rights, attempted to resell products without authorization, or acted in a manner harmful to Jungle Bravo, our customers, service providers, payment processors, or business operations.

We may also refuse, cancel, modify, or limit current or future orders or subscriptions associated with any account, email address, billing address, shipping address, payment method, or customer that we believe is connected to prohibited, fraudulent, abusive, or unauthorized activity.

Termination or suspension does not relieve you of any payment obligations, refund limitations, return requirements, indemnification obligations, or other obligations that arose before termination.

Any provisions of these Terms that by their nature should survive termination will survive, including without limitation intellectual property rights, payment obligations, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law provisions.

25. Changes to These Terms

Jungle Bravo may update, modify, or replace these Terms at any time in our discretion.

When we make changes, we may update the “Last Updated” date at the top of these Terms or provide other notice where required by law.

The updated Terms will be effective when posted on the Website unless a later effective date is stated.

Your continued access to or use of the Website, account, products, subscriptions, or services after updated Terms are posted constitutes your acceptance of the updated Terms.

You are responsible for reviewing these Terms periodically. If you do not agree to the updated Terms, you must stop using the Website and, where applicable, cancel any subscription or recurring purchase program before the next billing date.

26. General Terms

These Terms, together with any policies or terms incorporated by reference, including our Privacy Policy and any applicable subscription, shipping, return, refund, promotional, or product-specific terms, constitute the entire agreement between you and Jungle Bravo regarding your use of the Website and purchase of products from us.

If any provision of these Terms is found to be invalid, unlawful, void, or unenforceable, that provision will be deemed severed or limited to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
